Successful solution for offshore assets after Dispute Resolution Partner’s instruction

Dispute Resolution Partner Dipti Hunter’s considerable experience was of use at the right time when a beneficiary client turned to her for advice and guidance on how to reverse a decision taken by trustees in the absence of appropriate pension law and tax advice.

Having previously been let down by tax and legal advisers in relation to an asset transfer of UK assets held in offshore entities to an offshore fund, the client needed expert commercial litigation as well experience of how to rectify a breach of fiduciary duty by trustees.

A failure to pick up on the proper tax consequences by the trustees and prior legal advisers led to a dispute with HMRC along with a negligence claim against former tax and legal advisors. The new legal team also had to negotiate with trustees on how best to work together to assist the beneficiary.

Dipti worked alongside newly appointed tax advisors, accountants and a number of offshore legal teams to find a solution for the client.
